How Trump Could Be President Until 2037 Due To A Constitutional Loophole

With the 2024 election behind us and President Donald Trump back in office, many are speculating whether he could serve beyond the traditional two-term limit.

While the 22nd Amendment to the U.S. Constitution restricts presidents to two terms, a constitutional loophole might allow Trump to hold power until 2037.

Understanding the 22nd Amendment

The 22nd Amendment, ratified in 1951, states:

“No person shall be elected to the office of the President more than twice, and no person who has held the office of President, or acted as President, for more than two years of a term to which some other person was elected President shall be elected to the office of the President more than once.”

At first glance, this seems clear—no one can be elected more than twice. However, legal scholars and political strategists have pointed out a loophole that, in theory, could allow Trump to serve additional terms without violating the amendment.

The Loophole: Consecutive vs. Non-Consecutive Terms

Nowhere in the amendment does it state that a former two-term president cannot serve as vice president. While the 12th Amendment states that no person “constitutionally ineligible to the office of President” can be vice president, Trump—having already been eligible and served—might not fall under this restriction.

  1. Trump Won in 2024 – Donald Trump secured his second non-consecutive term as President in 2024, serving until 2029.
  2. Becomes Vice President in 2028 – In the 2028 election, a Republican nominee selects Trump as their running mate. If they win, he becomes vice president.
  3. The New President Resigns – Once in office, the elected president resigns or steps down, making Trump the President once again.
  4. Repeat in 2032 – The same strategy is applied in 2032, keeping Trump in the White House until 2037.

This strategy, though unprecedented, is not explicitly banned by the Constitution. If Trump were selected as vice president and ascended to the presidency through succession rather than election, he could theoretically serve additional terms.

Would the Supreme Court Intervene?

If such a scenario unfolded, the Supreme Court would likely be asked to rule on its constitutionality. Given that the Court interprets laws based on original text rather than intent, it is plausible that Trump’s team could argue there is no explicit prohibition against him serving additional terms in this manner.

Historical Precedents and Legal Interpretations

While no president has attempted this loophole, historical cases show that legal gray areas often lead to surprising political outcomes. For example:

  • Franklin D. Roosevelt was elected to four terms before the 22nd Amendment was introduced.
  • Grover Cleveland served two non-consecutive terms, proving a return to the presidency is possible.
  • Vice Presidential Successions have occurred multiple times, such as Gerald Ford assuming the presidency without an election.

These examples suggest that a strategic use of the Constitution’s wording could allow Trump to remain in power for an extended period.

Would the American People Support It?

Given Trump’s unwavering base, this strategy could gain support among Republicans who believe he is the best leader for America’s future. However, Democrats and constitutional purists would likely challenge any attempt to extend his presidency.

Conclusion: A Real Possibility or Political Theory?

While this remains a theoretical possibility, it highlights the importance of constitutional interpretation. If Trump’s legal team successfully argues this loophole, the United States could witness an extended Trump presidency unlike anything in modern history.
