To the above named Defendant: YOU ARE HEREBY SUMMONED to serve a notice of appearance on the Plaintiff’s Attorneys within twenty (20) days after the service of this summons, exclusive of the day of service (or within thirty (30) days after the service is complete if this summons is not personally delivered to you within the State of New York); and in case of your failure to appear, judgment will be taken against you by default for the relief demanded in the notice set forth below.

NOTICE: The nature of this action is to dissolve the marriage between the parties, on the grounds:  DRL Section 170 subd. (7) – the relationship between the Plaintiff and Defendant has broken down irretrievably for a period of at least six months. The relief sought is a judgment of absolute divorce in favor of the Plaintiff dissolving the marriage between the parties in this action.  The nature of any ancillary or additional relief demanded is: That the Plaintiff and Defendant shall have joint legal custody of the child of the marriage, Christopher Adams, born on August 10, 2006, however, the Plaintiff shall have primary physical custody, in accordance with the Stipulation and Order dated August 3, 2010, of the Family Court of Bronx County under Docket No. V-05925-10. That the Defendant shall have reasonable rights of visitation with the child away from the custodial residence, in accordance with the Stipulation and Order dated August 3, 2010, of the Family Court of Bronx County under Docket No. V-05925-10. That the order, dated August 3, 2010, of the Family Court of Bronx County under Docket No. V-05925-10 shall be continued, and the order, dated October 12, 2011, of the Family Court of Bronx County under Docket No. F-05930-10/14A shall be continued, and the Family Court shall have concurrent jurisdiction with the Supreme Court with respect to any future issues of maintenance, child support, custody and visitation. That the parties do not require maintenance and no claim will be made by either party for maintenance.  Neither party is seeking maintenance as payee as described in the Notice of Guideline Maintenance. That the Defendant shall pay to the Plaintiff, through the Support Collection Unit, PO Box 15363, Albany, NY 12212-5363, Twenty Five and 0/100ths Dollars ($25.00) per month on the fifteenth day of each month for child support, in accordance with the Order of the Family Court of Bronx County under Docket No. F-05930-10/14A. That the Plaintiff shall provide health insurance benefits to the child until the age of 21 years unless otherwise emancipated, in accordance with the Order of the Family Court of Bronx County under Docket No. F-05930-10/14A. That the Defendant shall pay 50 percent of the unreim¬bursed medical expenses of the child until the age of 21 years unless otherwise emancipated, in accordance with the Order of the Family Court of Bronx County under Docket No. F-05930-10/14A. That the parties do not require payment of counsel and experts’ fees and expenses. That both parties may resume the use of any prior surname. That the Court grant such other and further relief as the Court may deem fit and proper. The parties have divided up the marital property, and no claim will be made by either party under equitable distribution.
