Upon the reading and filing of the Petition of Ciro Paluso, verified the 7th day of February, 2014, the affirmation of Michael J. Gabrielli, Esq., dated February 7, 2014, and all exhibits and the official search of Chicago Title Insurance Company, a tittle insurance company duly authorized to transact business in the State of New York, and it appearing there that there is a mortgage recorded concerning the real property located at 658 Tiffany Street, Bronx, NY: that the mortgagor was the Petitioner herein, CASANOVA DEVELOPMENT CORP.; that the mortgagee was ACSUN REALTY CO., INC.; that the mortage was dated June 18, 1985; that the morgage was recorded June 21, 1985, in Reel 597 Page 1151, and that the premises, also known as Block 2765, Lot 132, is situate in Bronx County; and it appearing to my satisfaction that the Petitioner has made reasonable effort to ascertain the existence and location of the corporate mortagee was dissolved by proclamation of the New York Secretary of State on July 14, 2011, and Petitioner has not been able to determine or locate any former corporate officers or shareholders, all of whose names are unknown to Petitioner, or whether or not any of said officers or shareholders reside in or out of the State of New York, or if there was any successor to the corporation, or what the names and places of residence of their heirs, if any there be, of any such persons;
Now, upon motion of GABRIELLI LEVITT LLP it is,
ORDERED that all persons interested in the said mortgage be and they are hereby ORDERED to Show Cause before this Court at IAS Part 7 of the Supreme Court of the State of new York, to be held at the Bronx County Courthouse, located at 851 Grand Concourse, Bronx, NY 10451 at room 624, on the 14th day of April, 2014 at 9:30 a.m., or as soon thereafter as counsel can be heard, why said mortgage should not be discharged of record, and it is further
ORDERED that this Order shall be published once in two newspapers published in the City of New York, in Bronx County, the New York Law Journal and The Bronx Daily, on or before March 21, 2014, and served by personal service upon the City Register in the City of New York and any other interested parties on or before March 31, 2014; and such service shall be deemed good and sufficient.
