NOW COMES Plaintiff, by and through the undersigned counsel for this Order for Alternate Service. Plaintiff has made exhaustive efforts to serve Defendant Eulogio Cruz Ortiz including but not limited to hiring two process servers, requests for change of address forms and letters to Defendant’s home and Plaintiff’s efforts have not yielded personal service upon the Defendant.
IT IS ORDERED that Plaintiff’s Motion for Alternate Service shall be granted.
IT IS ORDERED that you, Defendant, are being sued by Plaintiff in this court for Divorce. You must file your answer or take other action permitted by law in this court at the court address above on or before July 1, 2013. If you fail to do so, a default judgment may be entered against you on that date for the relief demanded in the complaint filed in this case. A copy of this order shall be published once each week in the Bronx County Legal News/Newspaper for three consecutive weeks, and proof of publication shall be filed with this court.
IT IS ORDERED that Plaintiff shall send a copy of this order to the Defendant by registered mail, return receipt requested before the last date of publication.
