Upon reading and filing the affirmation of MARK S. MELEKA, ESQ., duly affirmed on the 15th day of November 2024, and the exhibits annexed thereto, and all the pleadings and proceedings heretofore had herein,
LET the plaintiff(s) and counsel for all defendant(s) herein show cause at an IAS Part 24, Room 623 of this Court, to be held at the Courthouse located at Supreme Court, of the County of Bronx, located at 851 Grand Concourse, Bronx, New York 10451 on the 9th day of January, 2025, at 9:30 o’clock in the forenoon of that day, or as soon thereafter as counsel can be heard, why an order should not be entered:
(1) pursuant to CPLR §321, relieving SUBIN ASSOCIATES, LLP, as the attorney for the Plaintiff, ERIKA EUGENIA SINCHI CARCHIPULLA.
(2) Pursuant to CPLR §2201, issuing a 45-day stay of all further proceedings including discovery deadlines and determination of any pending motions and/or conferences already scheduled in this case; and for such other and further relief as may be just and proper.
Sufficient cause appearing therefore, that service of a copy of this order, together with the papers upon which it is granted, be served upon plaintiff via daily publication in The Bronx Daily newspaper for one week, and that a copy of this Order, together with the papers upon which it is granted, be served by electronic service via NYSCEF upon SMITH MAZURE, P.C., Attorneys for Defendant, MEGA CONTRACTING GROUP, LLC., and upon GALLO VITUCCI KLAR, LLP, Attorney for Defendant, CONCERN ST. JAMES HOUSING DEVELOPMENT FUND CORP. on or before the 20th day of December, 2024, be deemed good and sufficient service.
Compliance Conference currently scheduled for November 26, 2024, is adjourned to February 20, 2025, at 9:30 a.m.
