The New York Child Victims Act creates a new opportunity for victims of childhood sexual abuse to hold perpetrators and enabling institutions accountable. The law will soon allow the civil prosecution of child sex abuse offenders in New York State as well as institutions that were culpable in allowing the abuse to continue. For one year, it does not matter how long ago the abuse occurred.
In essence, survivors will finally have a chance to take legal action against those people and institutions that allowed the abuse to happen. However, there is a small window to pursue these claims in court. The time period for filing falls only between August 14, 2019 and August 14, 2020.
The new law also removes the barriers to filing civil claims against government institutions. But, in order to file a claim where the statute of limitations has already passed, survivors have to file it in the one year time period referenced above.
