Indictments In The Attempted Murder Of An NYPD Police Officer

Manhattan District Attorney Alvin L. Bragg, Jr., announced the indictment of Mark McFadden, 53, Oliver Richardson, 50 and Joseph Gallishaw, 50, for an attempted armed robbery on the Upper West Side at 75th Street and Central Park West that led to a police chase in Riverside Park. The chase ended with McFadden shooting at responding officers. McFadden is charged in a New York State Supreme Court indictment with Attempted Murder in the First Degree and Attempted Aggravated Murder of a Police Officer, among other charges.

All three defendants are charged with Attempted Robbery, Criminal Possession of a Weapon and Endangering the Welfare of a Child.[1]

Gun violence is unacceptable in any form, but the alleged actions of these defendants put the lives of a father, his young child and an NYPD police officer serving our city at risk,” said District Attorney Bragg. “Everyone deserves to enjoy the scenic and historic views of the Upper West Side and Riverside Park safely and we will not tolerate this type of violence anywhere in Manhattan.”

According to court documents and statements made on the record, on the afternoon of January 06, 2023, McFadden, Richardson and Gallishaw followed the victim and his two-year-old child in their car for several blocks. After the victim parked his car and got out on West 75th Street, McFadden and Richardson exited their car and pointed guns at the victim and his two-year-old child, who was in his arms. A struggle ensued and McFadden’s gun discharged near the victim and his child’s head, striking a car behind them. The defendants then fled the scene driving westbound.

Police spotted McFadden, Richardson and Gallishaw’s car on the West Side Highway at approximately 04:00 p.m. Police attempted to pull the defendants’ car over with lights and sirens blaring. The defendants ignored the squad car and pulled over around 106th or 107th Street and Riverside Drive off the West Side Highway. All three defendants jumped out of the car and ran, hopping the fence to flee into Riverside Park, which was full of children playing after school on a Friday.

Police chased the defendants and arrested Gallishaw. Richardson hid by the wall on the stairs inside the park as McFadden ran up the stairs. McFadden turned around and shot at a police officer during the chase.

Richardson removed his outerwear as he hid. The clothing was recovered and matched the clothing he was seen wearing during the prior shooting and robbery incident. McFadden also changed his top, but his clothing from the earlier shooting and robbery was recovered. Police recovered one .45 caliber gun, one .380 caliber gun and one additional firearm on the pathway just over the fence where all three ran from police.

Assistant D.A.s Victoria Meyer and John Fuller are handling the prosecution of this case, under the supervision of Jeffrey Levinson (Chief of Trial Bureau 80) and Lisa DelPizzo (Chief of the Trial Division). Digital Evidence Analyst Sophia Horan, Investigative Analyst Matthew Ballou and High Technology Analysis Unit Analyst Borislav Vestfrid are assisting with the investigation.

D.A. Bragg thanked the NYPD, particularly Detectives Robert Maxcy and Paul Scott of the 24th Precinct Detective Squad; Police Officers Joseph Bonardi, John Carty and Liridon Ahmedi of the 24th Precinct; and Detective Hector Figueroa of the 20th Precinct Detective Squad.
