COMBINED NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND INTENT TO REQUEST RELEASE OF FUNDS

This Notice shall satisfy the above-cited two separate but related procedural notification requirements.

REQUEST FOR RELEASE OF FUNDS

On or about September 25, 2018, the New York State Homes & Community Renewal, through the New York State Housing Trust Fund Corporation (HTFC), will submit a request to the U. S. Department of Housing and Urban Development (HUD) for the release of 8 Project-Based Vouchers under section 8(o)(13) of the U.S. Housing Act of 1937 (42 U.S.C.1437f(o)(13)), in accordance with section 288 (42 U.S.C. 12838), to authorize 1182 Woodycrest, LLC to undertake a project known as 1182 Woodycrest, for purposes of new construction of a 9-story elevator building for families with 45 residential units, on a 0.17-acre site at 1182 Woodycrest Avenue in the City of New York, Bronx County. Nine of the proposed units will be set aside for persons 62 or older. The building will include a community room for residents less than 62 years of age and a community room for residents 62 years of age or older, and laundry services. An existing two-family building with detached garage on the site will be demolished to make way for the new construction, with an estimated total project cost of $17,022,255.

FINDING OF NO SIGNIFICANT IMPACT

HCR has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to Heather Spitzberg, either by mail to Environmental Analysis Unit, NYS Housing Trust Fund Corporation, 38-40 State Street, Albany, New York, 12207 or by e-mail to heather.spitzberg@nyshcr.org. All comments received by September 24, 2018 will be considered by HCR prior to authorizing submission of a request for release of funds. Those wishing to comment should specify which part of this Notice they are addressing.

ENVIRONMENTAL CERTIFICATION

HCR certifies to HUD that Ms. Heather Spitzberg, Esq. in her capacity as Certifying Officer consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows 1182 Woodycrest, LLC to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS

HUD will consider objections to its release of funds and HCR’s certification received by October 10, 2018 or for a period of fifteen days following its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of HCR; (b) HCR has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the project have committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to:
